1. Introduction

Welcome to WaveCoach ("we," "our," or "us"). By accessing or using our website, mobile application, and AI-powered surf analysis services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

WaveCoach provides an AI-powered tool that analyzes user-uploaded videos of surfing waves to provide feedback on technique, conditions, and performance. The feedback provided is generated by artificial intelligence and is for informational and educational purposes only. It should not replace professional in-person coaching or safety instruction.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Subscriptions and Payments

WaveCoach offers both subscription plans and pay-as-you-go credit options.

• Subscriptions: Billed monthly or annually as selected at checkout. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Credits: One-time purchases that allow for a specific number of analyses. Credits do not expire unless otherwise stated.
• Payment Processing: All payments are processed securely through our third-party payment processor, Stripe. We do not store your full credit card information.

5. User Content

You retain ownership of any videos or images you upload to the Service ("User Content"). By uploading User Content, you grant WaveCoach a non-exclusive, worldwide, royalty-free license to use, process, and analyze your content solely for the purpose of providing the Service to you and improving our AI models.

You represent and warrant that you have all necessary rights to the User Content you upload and that it does not violate any third-party rights or applicable laws.

6. Intellectual Property

The Service, including its software, design, text, graphics, and AI analysis methodology, is the exclusive property of WaveCoach and its licensors. You may not copy, modify, distribute, or create derivative works based on our Service without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, WaveCoach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

Surfing is an inherently dangerous activity. WaveCoach is not responsible for any injuries or accidents that may occur while you are surfing, regardless of whether you were applying techniques suggested by our Service.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sydney, NSW, Australia, without regard to its conflict of law provisions.
